Clery Act Amendments Regarding Crime Reporting

Reporting under the Clery Act has been amended to include the following:
Two new crime reporting categories (manslaughter and arson)
Arrests of persons referred for campus disciplinary action for liquor law violations, drug-related violations and weapons possession.
Redefinition of reporting areas: campus, non-campus building or property, and public property (See below)

Policy for Reporting the Annual Disclosure of Crime Statistics

The Eastern Michigan University Police Department prepares an Annual Security Report to comply with the Jeanne Clery Disclosure of Campus Security Policy and Crime Statistics Act. This report is prepared in cooperation with the Housing and Student Judicial Services Departments. Each entity provides updated information on their educational efforts and programs to comply with the Act.

EMU police officers enter all reports and all crime incidents reported directly into an automated case management software program called DDP Police Science. Once an officer enters the report in the program, a department administrator reviews the report to ensure it is appropriately classified in the correct crime category. The department periodically examines the data to ensure that all crimes that have been reported are recorded in accordance with the crime definitions outlined in the FBI Uniform Crime Reporting (UCR) Handbook and the FBI National Incident Based Reporting System (NIBRS) Handbook.

The Annual Security Report is updated each year and it is available on the EMU Web site at: www.emich.edu/publicsafety/safety.htm. Copies of the Annual Security Report may also be obtained at the EMU Police Department located in the parking structure or by calling 734.487.0892. Copies of the Annual Security Report, are distributed to EMU students, employees, prospective students and prospective employees as required by the Jeanne Clery Disclosure of Campus Security Policy and Crime Statistics Act.

Campus
Any building or property owned or controlled by an institution within the same reasonably contiguous geographic area and used by the institution in direct support of, or in a manner related to, the institution’s educational purposes, including residence halls; and any building or property within the same reasonably contiguous geographic area of the institution that is owned by the institution but controlled by another person, is frequently used by students and supporters for institutional purposes (such as food or other retail vendor).

Non-campus building or property
Any building or property owned or controlled by a student organization officially recognized by the institution; or any building or property (other than a branch campus) owned or controlled by an institution that is used in direct support of or relation to the institution’s educational purposes, is frequently used by students and is not within the same reasonably contiguous geographic area of the institution.

Public property
All public property that is within the same reasonably contiguous geographic area of the institution, such as a sidewalk, a street, other thoroughfare or parking facility, and is adjacent to a facility owned or controlled by the institution if the facility is used by the institution in direct support of, or in a manner related to the institution’s educational purposes.

Crime Statistics Summary Report

EMU is required under the Clery Act to provide the following Crime Statistics Summary Report related to its campus and other locations by calendar year. This EMU Crime Statistic Summary Report is sent annually to the Department of Education and can be viewed on the Office of Postsecondary Education – Department of Education’s website at http://ope.ed.gov/security/InstDetail.asp
