Export Controls and Embargoes

Export Controls are laws regarding the sending or transfer of items, services, and technology outside of the United States or to foreign nationals. These laws may apply in the following situations:

  • Sending certain items, information or software to a foreign country
  • Sharing certain items, information or software with foreign nationals in the United States
  • International travel
  • Collaborating with colleagues from or located in another country
  • Taking computers or other electronic devices to foreign countries

The above activities might require obtaining a license from the government. Note that it may take between 6 weeks and 6 months to obtain an export license. A more detailed explanation of Export Control laws can be found on the Regulatory Guidance page in the left menu.

    Violation of Export Control regulation is subject to both criminal and civil penalty for the university and the individual.  Penalties include fines and imprisonment, depending on the regulations violated and the organization that oversees the regulations. EAR violations carry individual fines of up to $250,000 and/or imprisonment of up to 10 years. ITAR violations can carry individual fines of up to $1,000,000 and/or up to 10 years in prison, and OFAC violations may be subject to individual fines of up to $1,000,000 and/or up to 20 years in prison. In addition, violations of any Export Control regulations are subject to seizure and forfeiture of goods and/or technology, denial of export privileges, and potentially exclusion from practice.
