9.5 University Reporting Policy Regarding Suspected Child Abuse/Neglect, Sexual Assault, and Child Pornography

University Policy Statement

The University strives to provide a safe and supportive learning and working environment for all individuals. In support of that goal, the University has established reporting protocols for its employees and other individuals with respect to suspected child abuse/neglect, sexual assault, and child pornography.

University Practice

Suspected Child Abuse or Child Neglect:

The University shall establish written policies requiring all employees, external contractors, students, and volunteers who are defined by the State of Michigan as "mandatory reporters" to report all incidents of suspected child abuse or child neglect, consistent with applicable law.

The University shall establish written policies requiring all other employees and external contractors who are not defined by the State of Michigan as "mandatory reporters" to report to the University's Department of Public Safety all incidents of suspected child abuse or child neglect.

The University shall establish written policies requiring all employees, external contractors, students, and volunteers to cooperate with any investigation conducted by the University's Department of Public Safety, law enforcement agency, and/or the State of Michigan Child Protective Services or its legal successor/designee regarding investigations of alleged child abuse or child neglect.

Sexual Assault

The University shall establish written policies requiring all employees, external contractors, and volunteers who receive an allegation of sexual assault by a member of the University community (employee, external contractor, student, or volunteer) to report the alleged sexual assault to the University's Department of Public Safety and the University's Title IX Coordinator.

These policies shall permit an individual to honor a request for confidentiality from an adult victim of sexual assault if the conversations with that individual are protected by a legally recognized privilege.

Child Pornography

The University shall establish written policies requiring all employees, external contractors, students, and volunteers who become aware of suspected child pornography on the University's information technology resources to report such incidents to the University's Department of Public Safety.

Responsibility for Implementation

The University's President has overall responsibility for implementing and enforcing this policy.

Scope of Policy Coverage

As described herein, this policy applies to all University employees (faculty, staff, temporary and all others), external contractors, students, and volunteers.
